1. Introduction and Scope #

1.1 This Privacy Policy (the "Policy") is issued by Mawrix ("Mawrix," "we," "us," or "our"), which operates the website located at manadesimarket.com, any installable web application made available through it, and all related pre-order, account, messaging, classifieds, business listing, notification, and community services that link to or reference this Policy (collectively, the "Services"), under license from the operators of the Mana Desi Market stores.

1.2 The Mana Desi Market store located at 9807 W Oklahoma Ave, Milwaukee, WI 53227 is operated by Triveni Foods LLC, and the Mana Desi Market store located at 17800 W Bluemound Rd, Brookfield, WI is operated by Triveni Supermarket LLC (each, a "Store Operator"). Each Store Operator is a separate legal entity, is solely responsible for the sale and fulfillment of goods at its location, and receives Personal Information from Mawrix only to the extent described in Section 8.2.

1.3 Mawrix is responsible for the Personal Information collected through the Services and processed as described in this Policy. Each Store Operator is responsible for Personal Information it receives from Mawrix, and for information it collects in its store, in accordance with this Policy and applicable law.

1.4 This Policy does not govern information collected offline, including at the point of sale in any store, except where such information is subsequently associated with the Services, nor the practices of any third party that Mawrix does not own or control.

1.5 By accessing or using the Services, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, you must not access or use the Services.

2. Definitions #

For purposes of this Policy, the following terms have the meanings set forth below:

2.1 "Personal Information" means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household, but does not include information that has been deidentified or aggregated such that it cannot reasonably be associated with an individual.

2.2 "Account" means a registered user account for the Services, established by verifying an email address or by signing in through a third-party sign-in service you choose.

2.3 "User Content" means any listing, job post, job application, photograph, description, message, report, review, flyer, or other material that a user submits, posts, or transmits through the Services.

2.4 "Community Features" means the classifieds, listing, messaging, reporting, blocking, business flyer, and related features of the Services through which users interact with one another.

2.7 "Usage Information" means information relating to your interaction with the Services, including pages viewed, features used, links and controls selected, the position of clicks and cursor movements, the extent of scrolling, the date, time, and duration of access, and the sequence of pages visited within a session.

2.8 "Service Provider" means a natural or legal person that processes Personal Information on our behalf, pursuant to a written agreement, for a business purpose described in this Policy.

2.9 "Tracking Technologies" means cookies, browser local storage, pixels, scripts, software development kits, and similar technologies used to store or access information on your device or to collect Device Information and Usage Information.

2.10 "Pre-order" means a request submitted through a pre-order form, by telephone, or by messaging to reserve goods for collection at a Mana Desi Market store, with payment tendered at the time of collection.

3. Categories of Personal Information Collected #

3.1 Information You Provide. We collect Personal Information that you provide, including:

(a) Pre-order information: your name, email address, telephone number, the items and quantities requested, preferred cut or preparation, and any comments you submit. Pre-orders are collected by or on behalf of the applicable Store Operator, either through the Services or through a third-party form provider; where a third-party form provider is used, submission may require that you be signed in to an account with that provider;

(b) Account information: your name, email address, the sign-in method you use, verification codes and the results of verification, the date and time you accepted our Terms of Use and this Privacy Policy, and your account preferences. An authentication service provider runs sign-in for us;

(c) Profile and location information: the Mana Desi Market store nearest to you and any neighborhood or city you elect to provide. We do not display your street address to other users;

(d) User Content, including listings, job posts, photographs, descriptions, prices, messages exchanged with other users (including any work history, résumé, or availability you choose to share with an employer when applying for a job), and reports you submit, together with the date, time, and recipients of such content;

(e) Business information, where you act as a Business User: business name, business telephone number, proof of local operation (such as a business registration, license number, or storefront address), flyer content, and placement purchase records;

(f) Communications information: the content of, and contact details associated with, communications you direct to us by email, telephone, text message, or messaging service; and

(g) Community information: where you join a messaging community for Mana Desi Market customers, which is administered by Store Operator personnel on a third-party messaging platform, the telephone number, display name, and profile information that you make visible to the administrators and other members of that community. Such information is collected by the Store Operator through the third-party platform and is not collected through the Services.

3.2 Information From Other Users. Other users may provide Personal Information about you, including in messages they send to you, in reports they submit regarding your User Content or conduct, and in content they post.

3.3 Information Collected Automatically. When you access the Services, we and our Service Providers collect, through Tracking Technologies:

(a) Device Information;

(b) Usage Information, including records of specific interactions, automatically captured interactions with page elements, heatmap data, and recordings of your session that reproduce page content, cursor movements, clicks, scrolling, and navigation ("Session Replay");

(c) your Internet Protocol (IP) address, and the approximate geographic location (such as city, region, and country) derived therefrom;

(d) referral and campaign information, including the referring website and any campaign parameters contained in the URL through which you arrived;

(e) pseudonymous identifiers assigned to your browser or device and stored on it, and, where you have an Account, the association of such identifiers with your Account;

(f) whether you are using the Services through an installed web application, and, if you enable notifications, the push subscription endpoint and keys associated with your device; and

(g) diagnostic and performance information, including errors, browser console output, network timing, page-load and rendering metrics, and technical details of any malfunction.

3.4 Payment Information. We do not collect payment card or bank account information through the Services for Pre-orders, which are paid in store at the time of collection. Where a Business User purchases a placement through the Services, payment card information is collected and processed directly by our payment processor, and we receive only a transaction record and limited card details (such as card brand and last four digits).

3.5 If you sign in through a third-party sign-in service you choose, that service shares your name, email address and profile photo with us.

4. Purposes of Processing #

4.1 We process Personal Information for the following business and commercial purposes:

(a) to receive and record Pre-orders submitted through the Services and transmit them to the applicable Store Operator for preparation and fulfillment, and to contact you regarding the status and collection of your Pre-order. Pre-orders submitted through a third-party form provider are received directly by or on behalf of the Store Operator;

(b) to administer the Pre-order program, including recording uncollected Pre-orders and applying the participation terms described in the Pre-order Policy;

(c) to create, verify, secure, and maintain Accounts;

(d) to operate the Community Features, including publishing User Content, delivering messages between users, and displaying business flyers;

(e) to review, moderate, and enforce our policies with respect to User Content and conduct, including by automated means described in Section 5.4, and to investigate and respond to reports;

(f) to send transactional notifications, including verification codes, message alerts, and listing status updates, by email, push notification, or text message;

(g) to send promotional communications, including weekly deals notices, where you have consented to receive them;

(h) to operate, maintain, and secure the Services, including diagnosing and correcting errors, measuring performance, and detecting, preventing, and responding to fraud, scams, abuse, and security incidents;

(i) to analyze how the Services are accessed and used, and to measure the reach and response to business flyers and placements, in order to evaluate and improve the Services and the operations of the Store Operators, including planning for additional locations;

(j) to develop and improve the Mawrix platform, using information in aggregated or deidentified form only; and

(k) to comply with applicable law, regulation, legal process, or enforceable governmental request, and to establish, exercise, or defend legal claims.

4.2 We do not use Personal Information to make decisions that produce legal or similarly significant effects concerning you based solely on automated processing.

5. Community Features #

5.1 Visibility of User Content. Listings, photographs, business flyers, and the display name and general area associated with them are visible to other users and to members of the public, and may be indexed by search engines. Photographs are processed to remove embedded location metadata before publication, but you are responsible for the content of the images you upload.

5.2 Messages. Messages you send through the Services are delivered to their recipients, who may retain, copy, or disclose them. We store messages to operate the Community Features and to review reported conduct. Our personnel access message content only to investigate a report, respond to a flag generated by our safety systems, or as required by law.

5.3 Contact details. We do not display your telephone number on listings. Contact details included in listings or in early messages between users may be masked automatically. If you elect to share contact details with another user, that user's use of them is not governed by this Policy.

5.4 Automated review. Before publication, the text of listings, job posts, and flyers may be analyzed by automated systems, including artificial intelligence models operated by our Service Providers, to identify content that may violate our Posting Rules. Such analysis informs, but does not replace, human review.

5.5 Reports, blocks, and enforcement. When you report User Content or a user, we process the report, the reported content, and related Account information. We do not disclose the identity of a reporting user to the reported user, except as required by law. We may remove User Content, restrict features, or suspend Accounts in accordance with our Terms of Use and Posting Rules.

5.6 Business Users. Information provided to verify a business, and records of placement purchases and performance (such as views, message starts, and call selections), are processed to administer placements and may be shared in aggregated form with the Business User concerned.

5.7 Deleted content. When you delete User Content or your Account, we remove it from public display within a reasonable period; however, copies may persist in the messages or records of other users, in backups for a limited period, and where retention is required under Section 10.

6. Text Messages, Push Notifications, and Email #

6.1 Text message consent. Text messages regarding Mana Desi Market are sent by Mawrix on behalf of Mana Desi Market. We send text messages (SMS) only to mobile numbers whose subscribers have provided express consent through the opt-in method presented at the time the mobile number is provided. Consent to receive promotional text messages is not a condition of any purchase.

6.2 Message types. Text messages may include (a) transactional messages, such as Pre-order status and collection notices, and alerts regarding messages or listings; and (b) where you have separately consented, promotional messages, such as weekly deals notices and store announcements from Mana Desi Market. Verification codes for signing in are sent by email, not by text message; if you sign in through a third-party sign-in service you choose, that service verifies you.

6.3 Frequency and charges. Message frequency varies. Message and data rates may apply according to your mobile carrier plan.

6.4 Opting out and help. You may opt out of text messages at any time by replying STOP to any message; you will receive one confirmation that you have been unsubscribed. Reply HELP for assistance, or contact us as described in Section 15. Opting out of promotional messages does not opt you out of transactional messages necessary to complete a Pre-order, which you may stop by replying STOP to such messages. Opting out of text messages does not affect signing in to your Account: verification codes are sent by email, and a third-party sign-in service you choose verifies you itself.

6.5 Carriers. Mobile carriers are not liable for delayed or undelivered messages.

6.6 No sharing of mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of Personal Information and disclosures described in this Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6.7 Push notifications. If you install the Services as a web application and enable notifications, we send push notifications through the notification service of your browser or operating system. You may disable push notifications at any time in your device or browser settings or in your Account settings.

6.8 Email. We send transactional emails relating to your Account, Pre-orders, messages, and listings. Where you have consented, we also send promotional emails, each of which contains a means to unsubscribe.

6.9 Telephone calls. Calls between you and a Store Operator, or between users and Business Users, may be placed or routed through telephone numbers operated by Mawrix, in which case we record call metadata, including the originating and receiving numbers, date, time, and duration, and may measure call volume for the purposes described in Section 4.1. Calls may be recorded or transcribed for quality, training, and dispute resolution purposes; where recording occurs, you will be notified at the beginning of the call.

7. Cookies, Local Storage, and Analytics Technologies #

7.1 The Services use Tracking Technologies, including first-party cookies and browser local storage, to authenticate Accounts, maintain session state, store pseudonymous identifiers, remember preferences, and record Device Information and Usage Information.

7.2 We use the following categories of Tracking Technologies, provided by our Service Providers:

(a) Product analytics, which may record page views, selected and automatically captured interactions, heatmap data, Session Replay, and related Device Information, IP address, and approximate location;

(b) Hosting, web analytics, and performance measurement, which may record request logs, page views, referral information, and page-load and rendering metrics; and

(c) Error and performance monitoring, which may record diagnostic information, browser console output, performance traces, and Session Replay of the period surrounding an error.

7.3 Where Session Replay is enabled, we configure it to mask text entered into form fields, including passwords, and we do not enable Session Replay on pages that display messages between users, Account settings, verification codes, or payment information.

7.4 We do not currently use Tracking Technologies to serve targeted advertising or permit third-party advertising networks to collect information through the Services. If we do so in the future, we will update this Policy and provide any choices required by law before doing so.

7.5 Your controls. Most browsers permit you to block or delete cookies and local storage. Blocking these technologies may prevent you from signing in or using certain features. Some browsers transmit a "Do Not Track" signal. Because no uniform standard governs the interpretation of such signals, the Services do not currently respond to them; the Services do not track you across third-party websites.

8. Disclosure of Personal Information #

8.1 No sale. We do not sell Personal Information, and we do not share Personal Information with third parties for cross-context behavioral advertising. Mobile information is subject to the additional restrictions in Section 6.6.

8.2 Store Operators. We disclose to the Store Operator of the applicable location the Pre-order information and related communications necessary for it to prepare, fulfill, and support your Pre-order, and information necessary to respond to inquiries directed to that store. Each Store Operator may use such information solely for those purposes and in accordance with this Policy. We may also provide Store Operators with reports in aggregated or deidentified form.

8.3 Other users and the public. User Content is disclosed to other users and the public as described in Section 5.

8.6 Business transfers. In connection with any merger, acquisition, financing, reorganization, bankruptcy, sale of all or a portion of assets, or transition of the Services to another provider, Personal Information may be disclosed in due diligence and transferred to the successor or acquiring entity, subject to the commitments made in this Policy.

8.7 With your direction. We disclose Personal Information to other parties at your direction or with your consent.

9. Location of Processing #

9.2 Certain Service Providers, including content delivery networks that serve the Services from locations near the user, may process Personal Information outside the United States in the course of providing their services. Where they do, we require them to protect Personal Information in a manner consistent with this Policy.

10. Retention #

10.1 We retain Personal Information for as long as reasonably necessary for the purposes described in this Policy and while we have a business need to do so, or for as long as required or permitted by applicable law (including for tax, accounting, legal, and regulatory purposes), whichever is longer.

10.2 We may retain Personal Information for a longer period where necessary to comply with legal obligations, to resolve disputes, to enforce our agreements and policies, to prevent fraud and abuse, or to maintain the safety of the Services, including records of reports and enforcement actions.

10.3 Upon expiry of the applicable retention period, we delete Personal Information or render it deidentified. We maintain and use deidentified information only in deidentified form, do not attempt to reidentify it, and contractually require any recipient of deidentified information to do the same. We may continue to retain and use deidentified or aggregated information subject to these commitments.

11. Security #

11.1 We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information against loss, misuse, and unauthorized access, use, alteration, and disclosure, including encryption of data in transit, access controls limiting internal access to authorized personnel, and logging of administrative access.

You are responsible for maintaining the security of the devices, email addresses and third-party sign-in accounts you use to access your Account and for the information you choose to share with other users.

12. Your Choices and Rights #

12.1 Choices. You may decline to provide Personal Information, although doing so may prevent us from fulfilling a Pre-order, creating an Account, or providing certain features. You may edit or delete your listings, disable push notifications and promotional emails, opt out of text messages as described in Section 6.4, leave any messaging community through the settings of the applicable messaging service, and control Tracking Technologies as described in Section 7.5.

12.2 Account deletion. You may delete your Account through your Account settings or by contacting us. Deletion is subject to Section 5.7 and Section 10.

12.3 Requests. Subject to applicable law, you may request that we (a) confirm whether we process your Personal Information and provide access to it; (b) correct inaccurate Personal Information; (c) delete Personal Information we hold about you; and (d) provide a copy of your Personal Information in a portable format. The availability of these rights depends on your state of residence and the applicability of the relevant law to us, and we may decline requests to the extent permitted by law.

12.4 Submitting requests. You may submit a request by email using the contact information in Section 15, or in person at a Mana Desi Market store as described in Section 15.2. We will verify your request by matching information you provide with information we maintain, which may include sending a verification code to an email address associated with your Account or asking you to sign in to your Account. You may designate an authorized agent to submit a request on your behalf, subject to proof of authorization. Requests concerning information held by a Store Operator may be directed to us, and we will coordinate with the Store Operator.

12.5 Response and appeal. We will respond to verified requests within the period required by applicable law. If we decline to act on a request, we will inform you of the reasons and, where required by applicable law, of any available means to appeal our decision.

12.6 Non-discrimination. We will not discriminate against you for exercising any right described in this Section.

13. Children #

13.1 The Services are not directed to children under the age of 13, and we do not knowingly collect Personal Information from children under the age of 13. Accounts and Community Features are available only to individuals who are at least 18 years of age.

13.2 If we learn that we have collected Personal Information from a child under 13 without verifiable parental consent, or that an Account is held by an individual under 18, we will delete the information or Account concerned. If you believe that a child has provided Personal Information to us, please contact us using the information in Section 15.

15. Changes to This Policy; Contact Information #

Where an amendment materially changes the manner in which we process Personal Information previously collected, we will provide notice through the Services, by email, or by other appropriate means before the change takes effect, and will obtain consent where required by law.
